Cyberimpact Referral Program Terms & Conditions


These terms and conditions (the “T&C”s) apply to your access and participation in Cyberimpact Inc.'s (“Cyberimpact”) referral program (the “Program”).

The Program offers holders of a billable Cyberimpact plan (each a "Referrer") the opportunity to receive billing credits for referrals that meet the terms of the T&C. Cyberimpact, at its sole discretion, reserves the right to terminate, modify, add, discontinue or remove the T&C, the Program, benefits, offers or rewards, in whole or in part, at any time, with or without notice. Any changes or modifications will be effective immediately upon posting.

A Referrer gets a $30 billing credit for each new customer they refer in accordance with the terms of the T&C. A client who has been referred by a Referrer will also obtain a billing credit of $30 as soon as they subscribe for a billable Cyberimpact plan.

  1. What are the eligibility criteria for the Program?

To be eligible, a Referrer must implement and comply with all of the following requirements:

  1. Subscribe to an active billable Cyberimpact plan;
  2. Configure your account to make payments to Cyberimpact by automated credit card payment; and
  3. Refer users who are neither Cyberimpact customers, nor identified as a contact or a user of a Cyberimpact plan, and who sign up for a billable Cyberimpact plan after clicking on the Referrer's referral link (a "Referred Customer").

The Referrer will receive their billing credit as soon as the Referred Client who has fulfilled the conditions below has paid their first bill.

The Referred Client will receive their billing credit when they have fulfilled the following conditions:

  1. Registration for a billable Cyberimpact plan using the same browser that was used to click on the Referrer's referral link, within 7 days of the Referred Client's initial access to the referral link; and
  2. Configuration of their account in order to make payments by automated credit card payment.

A Referred Client can only obtain a billing credit once, unless they become a Referrer.

Accumulated billing credits can be used as long as your Cyberimpact account is active. They will be lost if you close your account. Billing credits cannot under any circumstances be transferred to another account.

Existing Cyberimpact users cannot refer each other. Cyberimpact employees, contractors, subcontractors, partners, ambassadors and agencies are not eligible to participate in the Program.

  1. What are the terms of our Program?

Application of billing credits. Billing credits will automatically apply to the next monthly bill payable by credit card. If the Referrer obtains more billing credits than the amount of the charges on their next monthly invoice, all excess billing credits will be carried over to the next monthly invoice. This cycle will continue until all billing credits are used or until the Referrer becomes ineligible.

Credits not payable in cash. Billing credits have no cash value and can only be redeemed as billing credits valid on invoices issued by Cyberimpact. A Referrer cannot receive a check, refund, or other form of settlement for the balance of a billing credit.

Cumulative offer. A Referrer may combine this offer with any previously acquired discounts and promotions.

Fraud. Any fraudulent or abusive submission or any attempted fraud committed by a user to obtain a billing credit, will grant Cyberimpact the right to refuse the billing credit request. Any use of automated or programmed methods, or any other similar method, to attempt to participate in the Program is prohibited. Cyberimpact will cancel all outstanding billing credit requests and the user's account will be closed.

Additional Terms. Other terms and conditions may apply to the Program, including those of any applicable promotional offer. These T&C do not replace Cyberimpact's Terms of Use, Privacy Policy and Anti-Spam Policy, which continue to apply to your use of Cyberimpact.

  1. What are the limitations of liability applicable to our Program?

Computer problem. Cyberimpact is not responsible for lost or incomplete billing credit requests due to any hardware or software failure or error, or any other human, mechanical, electronic or network error.

Errors and omissions. Cyberimpact denies all liability in the event of incorrect or inaccurate information in connection with the use of the Program by a user and denies all liability for errors, omissions, deletions, interruptions or delays in the operation or transmission or the failure of line of communication, theft or destruction or unauthorized access to the Cyberimpact website.

Damages. Generally, Cyberimpact and its directors, officers, employees, affiliates, agents, contractors, interns, suppliers and service providers, assume no liability for any damage or injury, loss or claim, including any business interruption, loss of profit, loss of software, data or program (including legal costs and attorneys' fees), arising directly or indirectly from:

  1. The user's computer equipment or of any other person in the context of participation in the Program; or,
  2. Change, suspension or discontinuation of the Program.

These limitations of liability apply to the fullest extent permitted by law.
