Bylaws, Permits, and Policies

Future Drive-Throughs and Gas Stations - Proposed Prohibition

With direction provided from Council during the January 27th, 2025, Regular Meeting, staff presented Bylaw No. 2780, Amendment No. 179 to City of Kimberley Zoning Bylaw No. 1850, 1994 and requested that Council direct staff to provide notice of first reading to the bylaw. The bylaw amendments include language that prohibits future drive-throughs and gas stations as well as text amendments to the definitions section. Council approved the recommendation and directed staff to proceed with providing notice of first reading. The item will come back to a future Council meeting. Bylaw No. 2781, 2024-2028 Five Year Financial Plan Bylaw No. 2761, Amendment No. 2, 2025 for consideration of adoption

Subsequent to providing first three readings at the February 10th, 2025 Regular Meeting, Council officially adopted Bylaw No. 2781, 2024-2028 Five Year Financial Plan Bylaw No. 2761, Amendment No. 2, 2025. This amendment incorporates changes to the 2025 Capital Projects including previously approved budget amounts, the timing of certain projects, as well as the addition of new projects. Development Permit 2024-008 - 91 and 93 Wallinger Avenue

City Planner, Erian Scott-Iversen, presented this Development Permit to Council, recommending that they defer a decision on the multi-unit residential development application and request further information from the applicants that incorporate more pedestrian-friendly design elements. Ultimately, Council decided to issue the permit to allow the multi-unit residential development subject to several conditions as presented in the staff report at the agenda link above. New Business

Notice on Title

Building Official Andy Christie, presented two properties recommended for Notice on Title under Section 57 of the Community Charter, which allows local governments in B.C. to place a notice on a property title when a building code or bylaw has been violated. Council directed the Corporate Officer to file notice with the B.C. Land Title Office. Information related to the subject properties is available in the staff reports at the agenda link above. 


 

Housing Infrastructure and Communities Canada - Active Transportation Fund Grant Application

Council directed staff to develop and submit a grant application to the Housing Infrastructure and Communities Canada - Active Transportation Fund Grant program for $270,000 or 60% of the $450,000 required to complete the 4th Avenue Multi-Use Pathway Connection project as outlined in the staff report from the Manager of Community Development and Communications. If the grant is approved, the pathway will provide safe access from Wallinger Avenue at Howard Street to the entrance to Morrison Subdivision. A subsequent application will be submitted to the provincial Active Transportation fund and remaining funding requirements will be provided from reserves. 


Appointment of 2025 Parcel Tax Roll Review Panel

Council appointed Councillor Cairns, Councillor Roberts and Manager of Planning and Sustainability Troy Pollock to the 2025 Parcel Tax Roll Review Panel. The panel meets annually to consider complaints related to the parcel and flat tax rolls from owners of properties in Kimberley on which parcel taxes are imposed for the first time, after which the tax rolls are authenticated. 2025 AKBLG Convention Attendee Authorization

The 2025 Association of Kootenay & Boundary Local Government (AKBLG) Convention is being held in Kimberley from April 25 - 27. In light of this, all City Councillors and Mayor McCormick have been authorized to attend.


Notice of Motion from Councillor Cairns - Enhancing Rural Transportation Systems in Kimberley/Cranbrook/ʔaq̓am and East Kootenay Region

Councillor Cairns brought forth a Notice of Motion to direct staff to submit a resolution to the AKBLG Annual General Meeting to request that the Union of British Columbia Municipalities (UBCM) advocate for increased funding and resources from the provincial and federal governments to expand and improve inter-community transportation services in the Kimberley/Cranbrook/ʔaq̓am and East Kootenay region and to support initiatives aimed at enhancing the frequency, coverage, and reliability of inter-community transportation to better serve the needs of residents and promote sustainable and equitable access to transportation in the region. The resolution is due February 28th, 2025. See the report and subsequent discussion at the links above.
